A mother was accused of taking a drunken bath while her four-year-old drowned in a car.
OAKDALE, Calif. (WKRC) – A mother was accused of taking a drunken bath, while leaving the scene of a crash as her four-year-old daughter drowned in a car.
According to the Stanislaus County District Attorney, Juliette Marie Acosta, 26, of Oakdale, has been charged with the murder of her 4-year-old daughter, Reagan Herrin, following a tragic incident on March 8.
Acosta was initially arrested after a crash in an irrigation canal near Hickman, California. According to the criminal complaint, she was allegedly driving with a blood alcohol content nearly three times the legal limit of 0.08% when the crash occurred.
CBS News reported that Acosta was arrested again in San Francisco on Friday near a downtown hotel after she attempted to flee. She had been out on bail for the DUI charge, but the California Highway Patrol attempted to serve a no-bail warrant on the new murder charge, per the network.
The charges also allege that Acosta left her partially submerged vehicle, failing to render aid to her trapped daughter, and was later found taking a bath while her daughter remained in peril.
District Attorney Jeff Laugero announced the charges, which include murder, vehicular manslaughter, and driving under the influence of alcohol causing injury.
The charging document includes circumstances in aggravation, citing the death of a vulnerable victim. If convicted on all charges, Acosta faces a maximum sentence of life in prison.
“We recognize the significant interest the community has in this case,” said District Attorney Laugero. “However, our responsibility to both the victim and the integrity of our legal system requires a thorough investigation based on the evidence and the law. This methodical approach ensures that justice is pursued based on accurate information. I appreciate the public’s patience and understanding in protecting the process and ensuring our ethical obligations are met. Justice requires our absolute adherence to these standards.”
Acosta is currently being held without bail, having been transported from San Francisco back to Stanislaus County by the California Highway Patrol.
When speaking to The Independent, Acosta’s attorney said the allegation involving his client taking a bath after the crash was false.
“Timeline-wise, it’s almost impossible to have done both of those. Time-wise, you can’t go take a bath while your daughter’s drowning if it’s in (a) canal, not next to a home– logically, it just doesn’t make sense,” her attorney told the publication.
According to The Sacramento Bee, Reagan was pulled from the vehicle by her uncle, who reportedly lives near the scene of the crash. The child reportedly died at the hospital, according to PEOPLE.
“This is an incredibly tragic and devastating situation,” he said. “I remain confident that the truth will come to light. Reckless misinformation only serves to harm our community further,” Acosta’s attorney told The Bee.
